Whether you are young or old, it is never too early or too late to plan for the protection of your assets and the prosperity of your loved ones. At The Law Offices of Randy J. Milou, it is our goal to provide you with the tools and structures necessary to preserve your family’s wealth and maximize tax benefits. We will work with you to design an Estate Plan that fits your specific needs and goals.
With the proper planning
- You can determine who would become the guardian of your minor children;
- You can control how your estate will be distributed;
- You can ensure that your wishes regarding your property and decision-making will be honored in the event of your illness or death; and
- You can select the person who will administer your estate.
At The Law Offices of Randy J. Milou, we offer a number of different planning options, ranging from the Simple Will to a Complex Formal Estate Plan. Attorney Milou will personally work with you to create an Estate Plan that meets your particular needs.
Attorney Milou’s experience in this field allows him to handle virtually any situation, including the following:
List of Services
-
WillsList Item 1
Creating a Will is the most common form of estate planning. Essentially, you tell the court in writing, with certain formalities, how you want your assets distributed and who will be responsible for the distribution. A Will also tells the court who you want to be named as the guardian of your minor children or pets.
-
Sweet Heart WillsList Item 2
Are you recently married or having your first child? Have you been married for 30 years or having your sixth child? No matter what your situation is, as long as you are married, a Sweet Heart Will is what you need. Create one Will that tells the court what your and your spouse’s intentions are.
-
Irrevocable TrustList Item 3
An Irrevocable Trust is created under your Will and controls the management of your assets after your death. These trusts have a wide array of uses, but they are very often used to provide for the management of assets for minors and young children in the event they might become entitled to receive property under a Will.
-
Living TrustList Item 4
A revocable Living Trust will help you to maintain control over the administration and distribution of your assets if you become disabled or when you pass away. A properly drafted Living Trust can avoid the time and expense of the probate process. It can also provide a means for a trustee of your choosing to take over control of the trust during your lifetime, if you desire, or if you become incapacitated. A Living Trust can avoid or reduce federal estate taxes.
-
Health Care Proxy
The Health Care Proxy is a document which allows you to name someone to make health care decisions on your behalf if you are unable to make or communicate those decisions. The purpose of a Health Care Proxy is to eliminate the need to guess when it comes to your directives.
-
Power of Attorney
A Power of Attorney allows you to designate a person you trust to handle certain responsibilities in the event of your disability or if you are unable to handle those matters on your own.
-
Guardianship Plans
If you have children they are probably the most important things in this world to you. Don’t let the Commonwealth decide what happens to them if you die. Through a Guardianship Plan you can dictate what will happen to your children.
-
Letters of Intention
Under the new Massachusetts Uniform Probate Code a person can express his or her interests with regard to tangible personal property (such as jewelry, furniture, paintings, tools, etc.) without specifically mentioning each and every item in the Will. A proper Letter of Intention can allow you to express your intent with regard to all of your tangible personal property.
At the Law Offices of Randy J. Milou, we provide Estate Planning services to the families of Western Massachusetts. Don’t let the Commonwealth dictate what happens to your belongings.
